Property management agreement

A property management agreement (mandat de gestion) is the contract by which an owner appoints a management company, or a relative, to run their short-term rental in their name and on their behalf.

We have found no Moroccan text specific to this agreement: it falls under the general rules on agency in the Code of Obligations and Contracts (DOC, articles 879 to 942). The agent, often a management company (“conciergerie”), acts in the name and on behalf of the owner, who remains the landlord: the income is the owner's, and the company is paid a management fee or a flat fee.

What the DOC already provides

  • an agency carried out as a profession is not presumed to be free (article 888);
  • the agent gives a detailed account of expenses and collections, with supporting documents (article 908);
  • the owner can revoke the agreement at will, but an abrupt, untimely termination can give rise to damages (articles 931 and 942).

Everything else goes in the contract: scope, powers, collections, the basis of the fee, administrative duties such as the police registration form, the owner's own stays and exit terms. Do not confuse it with leasing the property to the company, the so-called “guaranteed income” model, which follows other rules. Our property management agreement guide covers the clauses; have a lawyer review your own agreement.
